The terms “I,” “me,” “we”, “Kate Remmer”, “Kate”, “Kate at STUDIOKTR”, and “STUDIOKTR” refer to Katie Remmer- Sole Trader. The term “Site” refers to studioktr.co.uk. The terms “user,” “you,” and “your” refer to site visitors, customers, and any other users of the site. The term “Service” refers to any blog or audio posts, digital products free or paid, free giveaways, courses, printed guides, printables, Branding Journey, web design or physical products.

Use of studioktr.co.uk, including all materials presented herein and all online services provided by STUDIOKTR are subject to the following Terms and Conditions. These Terms and Conditions apply to all site visitors, customers, and all other users of the site. By using the Site or STUDIOKTR Services or Products, you agree to these Terms and Conditions, without modification, and acknowledge reading them.

Kate at STUDIOKTR privacy policy & GDPR compliance information

This privacy policy sets out how STUDIOKTR uses and protects any information that you give STUDIOKTR when you use this website.

STUDIOKTR is committed to ensuring that your privacy is protected. Should we ask you to provide certain information by which you can be identified when using this website, then you can be assured that it will only be used in accordance with this privacy statement.

STUDIOKTR may change this policy from time to time by updating this page. You should check this page from time to time to ensure that you are happy with any changes. This policy is effective from 19, October, 2016.

What we collect

We may collect the following information:

  • name
  • email address
  • demographic information such as postcode, preferences and interests
  • other information relevant to customer surveys and/or offers

What we do with the information we gather

We require this information to understand your needs and provide you with a better service, and in particular for the following reasons:

  • Internal record keeping.
  • We may use the information to improve our products and services.

Links to other websites

Our website may contain links to other websites of interest. However, once you have used these links to leave our site, you should note that we do not have any control over that other website. Therefore, we cannot be responsible for the protection and privacy of any information which you provide whilst visiting such sites and such sites are not governed by this privacy statement. You should exercise caution and look at the privacy statement applicable to the website in question.

Controlling your personal information

You may choose to restrict the collection or use of your personal information in the following ways:

  • if you have previously agreed to us using your personal information for direct marketing purposes, you may change your mind at any time by writing to or emailing us at kate@studioktr.co.uk

We will not sell, distribute or lease your personal information to third parties unless we have your permission or are required by law to do so. We may use your personal information to send you promotional information about third parties which we think you may find interesting if you tell us that you wish this to happen.

You may request details of personal information which we hold about you under the Data Protection Act 1998. https://www.gov.uk/data-protection/the-data-protection-act. A small fee will be payable. Please contact us via email at kate@studioktr.co.uk

If you feel that you have had an issue with STUDIOKTR, and we were unable to resolve it with you, you may contact the Online Resolution Platform at https://webgate.ec.europa.eu/odr/main/index.cfm?event=main.home.chooseLanguage for some assistance.

If you believe that any information we are holding on you is incorrect or incomplete, please write to or email us as soon as possible, at the above address. We will promptly correct any information found to be incorrect.

GDPR Compliance

Under this new regulation, you have the right to change, edit, update, delete or just ask about the information I hold on you. Below I have detailed out which programs I use and how I use your information. Please get in touch with me at kate@studioktr.co.uk if you have any questions or would like to make any changes/amends to your data and I will action it immediately.

GOOGLE ANALYTICS: 

On May 22, 2018 I have officially removed Google Analytics tracking from www.studioktr.co.uk in order to simplify my data collection. It was the same day as my cookie report (see below) so some of the Google Analytics cookie data is still there, but should drop off by the next reporting date of June 22, 2018.  Instead of Google Analytics, I’m now using Mouseflow to collect website user behaviour.

MOUSEFLOW:

I use Mouseflow to analyse website user behaviour, in order to improve my website and services. Mouseflow is fully GDPR compliant.

Mouseflow is a website analytics tool that provides session replay, heatmaps, funnels, form analytics, feedback campaigns, and similar features/functionality. Mouseflow may record your clicks, mouse movements, scrolling, form fills (keystrokes) in non-excluded fields (more details below), pages visited and content, time on site, browser, operating system, device type (desktop/tablet/phone), screen resolution, visitor type (first time/returning), referrer, anonymized IP address, location (city/country), language, and similar meta data.

No personal data is ever sent or shared between websites. The script does not use third-party cookies and none of the data is shared with third parties except for highly summarized data (i.e. usage share of browsers, average screen size, etc.).

Mouseflow does not collect any information on pages where it is not installed, nor does it track or collect information outside your web browser.

If you’d like to opt-out, you can do so at https://mouseflow.com/opt-out.

If you’d like to obtain a copy of your data, make a correction, or have it erased, please contact me first at kate@studioktr.co.uk or, as a secondary option, contact Mouseflow at privacy@mouseflow.com.

More about what Mouseflow collects for EU visitors:

  1. Location data of www.studioktr.co.uk visitors, However, the current location data are approximations with decreased accuracy, due to the IP addresses of all EU visitors being anonymized, by removing the final octet (last three digits), thereby removing the opportunity to pinpoint any single visitor on www.studioktr.co.uk. Anonymized IP addresses (so it cannot pinpoint any specific visitor–it can only be able to locate the approximate city of the visitor).
  2. All data recorded on EU accounts are stored on dedicated EU servers-none of it will ever be stored outside of the EU.
  3. Since December 14th, 2017, Mouseflow has been automatically masking all keystroke data for any EU account and all EU visitors, in all input fields and text area elements on websites recorded by EU accounts. By default, Mouseflow excludes all password and credit card number fields automatically.

All data collected on Mouseflow on behalf of STUDIOTKR prior to 22/3/2018 has been fully deleted.

Mouseflow takes security very seriously. They only use the most trusted and secure data centers for their platform. Access is restricted to a few select employees and data from SSL-encrypted pages are only transmitted across encrypted SSL connections.

I honour the DNT (Do-not-track) setting from browsers (even though it is not required of me to do so). So, if you have set this up in your browser, I will not record your session on STUDIOKTR with Mouseflow.

Mouseflow is fully GDPR compliant.

MAILMUNCH.CO:

If you subscribed through an opt-in form either on my website or on social media for the Get Authentic Challenge or the Mini Branding Journey, then you may have subscribed through a Mail Munch form which then connects through to Mailchimp. I no longer run these opt-ins and no longer use Mail Munch in an attempt to simplify my data collectors.

Mail Munch is a company that I used to generate opt-in forms as pop ups or embedded forms on my website and social media. When you signed up for one of my above mentioned opt-ins using a Mail Munch form, they collect your first name and email address (as this is what you had to enter into my opt-in form) and your IP address. This information is stored on their system and then synced with my MailChimp account through a MailChimp API call which is completely secure and up to industry standards.

If you would like to have your details removed from the Mail Munch system, please email me at kate@studioktr.co.uk and I will remove you immediately.

I have deleted all information for subscribers who appeared to be in the EU. If you’d like me to check your details, please email me at kate@studioktr.co.uk as soon as possible.

I am waiting to confirm their server location(s), and that they will be 100% GDPR compliant by May 25, 2018.

MAILCHIMP:

Mailchimp is a data collector and email marketing service I use to collect names and email addresses for my opt-in giveaways and e-mail marketing.

On their website, in regards to the GDPR they state:

“We’ve already implemented strong privacy protections that mean we’re handling your subscribers’ data appropriately and in line with EU legal requirements.

MailChimp has certified to the EU-U.S. Privacy Shield Framework and Swiss-U.S. Privacy Shield Framework, so you can transfer your subscribers’ personal data outside of the EU to MailChimp in the U.S. so long as you:

-Complete our updated data processing agreement and
-Get permission from your subscribers to transfer their data. Permission terms will be built directly into our GDPR-friendly forms, but you should copy that language over to your other list building methods, too.”

For your reference, I have completed the Updated Data Processing Agreement with Mailchimp.

If you would like to change/edit/delete the data I hold on you within Mailchimp, please write to me at kate@studoktr.co.uk

Alternatively, you are also welcome to continue to update your own data, too, by contacting Mailchimp directly or choosing to update your preferences in any email you receive from me (Kate at STUDIOKTR), in the footer section.

Please note that I use your data to send you free content, promotions I think you may be interested in, and other information to help improve your brand and web site. I will not sell your information on to third parties.

From April 2018, onwards, I am now using a program called Kartra to have all of my email marketing, sales pages and more under one secure roof (please see details below about Kartra). I am keeping my Mailchimp account active with my list of subscribers, so that I have evidence of my subscribers subscribing to my list. Please see the below details about Kartra.

Kartra:

From April 2018, I am now using Kartra for all of my email marketing, campaigns, sales pages and more. I’m doing this in order to keep all of my data collection and payment processing under one secure roof and to simplify the way that I collect personal data.

On Kartra’s Website they state: “Kartra will be compliant on or before 25 May 2018, the date the GDPR comes into force in the EU. We have a deep commitment to the privacy and security of your data, as well as your ability to access it. Maintaining compliance to GDPR constitutes no significant change in our philosophy or business practices. For instance, Kartra is already EU Privacy Shield certified, guaranteeing privacy for data transmitted from the EU.”

I will follow all of Kartra’s suggestions and rules to ensure I’m inline with the rules of the GDPR. If you wish, (just as with mailchimp) to see, change, edit or erase the information I hold on you in this system please be in touch with me at Kate@studioktr.co.uk and I will action your request immediately.

As a quick guide, if you sign up to my opt-ins like The Oracle at STUDIOKTR, prior to May 25, 2018, I will ask you to re-sign up to my marketing list and require that you’ve read this privacy information before accepting your request to subscribe.

After May 25, 2018 if you sign up for my opt-in, you will be required to ready my Privacy Policy, but you will only be added to my list to receive my opt-in. I will send you a separate invitation to see if you would like to opt-in to my marketing list so you can continue to receive future emails from me with promotions/offers/hints and tips to help your brand.  If you do not choose to opt-in to my email marketing emails, your personal data you provide (to receive my free opt-in) will only be held for 1 month, after which I will delete you out of my Kartra account. If you would prefer that I do this sooner, please email me at kate@studioktr.co.uk and I will action it immediately.

Through Kartra I will hold your first name and email because this is what you’ll need to use to sign up to my Oracle library. Kartra also keeps track of your IP address and IP country.

If you’ve opted-in to receive marketing emails from me, I will use your details to send you emails with hints and tips for your brand and website and also promotions that I feel you may be interested in. I will not share or sell your details on to third parties. If you decide you no longer want to be on my email marketing list, you may unsubscribe on the bottom of any of the emails I’ve sent you from April 2018 onwards (or email me at kate@studioktr.co.uk) as soon as possible.

If you purchase products from me, they will be on secure pages on Kartra and the payment will be processed securely between Kartra and Paypal (I will not personally hold any payment details for you). If I invoice you or send contracts to you, I will need to hold your name, address, and email address as these are legal documents.

If you sign up to my “Branding with Kate – the 6 week path to effortless attraction” course, you will be added to my email list for correspondence about the course only and so you can receive your receipt for your payment and your course log-in details. I will not add you to my email marketing lists, but I may invite you to opt-in to my email marketing list. I will hold your data (that you used to sign up for the course) in my account indefinitely because I want you to have access to the course materials. If you want to edit/change/delete/erase or alter your information at any time, please email me at kate@studioktr.co.uk. Please understand that if you request for me to delete you out of the membership area, you will loose access to the course.

I will be adding more information from Kartra as it becomes available to me.

STUDIOKTR website:

Besides the above mentioned Mouseflow program I use to capture non-personal data on www.studioktr.co.uk, I used to have a contact form on my site. If you emailed me using that form prior to May 25, 2018, your details are in my email system provided my hosting provider 123 Reg.

In order to simplify my systems, I have removed this contact form. If you need to get in touch with me, my contact details are still on my contact page. Please understand 123Reg will house any data needed for you to email me. If you would like me to edit/change/delete/erase any of your details out of my email system, please let me know  by sending another email to kate@studioktr.co.uk and I will action your changes immediately.

I’m also under application to obtain my SSL certificate for the studioktr.co.uk website even though I will not be selling any products through this site. All my products and payment processing will be done through Kartra.  I have received my security certificates and am in the process of applying it to my site with the help of my hosting provider. Once the site is fully secure, I will update this part of my policy.

10 to 8: 

10 to 8 is my appointment scheduling program. If you set-up an appointment with me, the details you provide are stored in their system. They collect your first name, email and phone number and require you to give them permission (by clicking a box) before setting up the appointment, to store the details in their system. If you do not want them to hold these details about you or you’d like to change/update/amend your details, please let me know and I will contact them to delete you out of their system. They are working to be GDPR compliant by May 25, 2018. Please contact me at kate@studioktr.co.uk and I will action your request immediately.

Please also note that by booking an appointment with me, I will put you into my Dubsado account so that I can keep track of our interactions, email you with any information you ask of me (quotes, pricing, etc….) and so forth. This is NOT the same as email marketing. I will NOT put you into my email marketing list unless you request it. If you request it, I will send you the proper link to sign up to that separately.

Webmail:

My hosting provider also hosts my email. So, if you’ve written me an email (either through my old contract form or directly) my hosting provider holds your email address and name. I am working with them to ensure those details are safe and that my hosting provider will be GDPR compliant. As more information becomes available, I will update this page.  If you’d like your information changed, updated, deleted please let me know as soon as possible at kate@studioktr.co.uk.

Surveymonkey: 

Survey monkey is a third party software I use for customer feed back surveys and market research. The surveys are anonymous, but I’m working with them to see if they collect any of your personal details. They are working to be GDPR compliant and as more information becomes available to me I will update this section.

Payment processing:

Currently I use Transferwise, Paypal or bank transfer for my client’s payments. All the payments are handled through those sites, so please check before sending me payment how these companies handle your money and personal details. I do not record or keep any payment details on my clients other than first name, last name, business address on my invoices as required. Payments for the Branding with Kate course will be handled through Kartra and Paypal’s integration and as more information becomes available to me I will update this page.

Past & Present clients & DUBSADO:
I will keep your contact information like name, address, email, phone, as required on invoices and for communication. All EU client files and artwork and any other information necessary to create your brand and/or website is stored on a secure cloud server and a physical back-up drive which is locked in a secured place and updated weekly. If you have questions about what personal data I hold, want to edit/change/erase details I hold on you, please be in touch with me at kate@studioktr.co.uk.

I will be sending you an email shortly to invite you to opt-in to my email marketing list exclusively for past/current clients so you can get info about referral bonuses, promotions/offers for services I feel would be a good fit for you. You may continue to email me through regular email (details about 123 reg and my regular email above) if you have questions about previous work I did for you, current things we’re working on together, or if you want future quotes. But any information I send to you outside of this, I will ask you to opt-in to receive and if you opt-in, your details will be held in Karta (as outlined above).

In order to simplify and secure my systems, any new clients/leads from May 2018 onwards will have our communications, files, forms, contracts and more secured through your own private client portal on my new software Dubsado. Dubsado are prepared to be fully compliant by May 25, 2018 and as more information becomes available, I will update this policy.

What are cookies and how does STUDIOKTR use them?

What is the web design process?

I (Kate Remmer) will design the look and feel of your website and make sure it looks good on mobile devices using templates from Wix or Squarespace or a WordPress Theme. Please note that I design the look and feel of websites, I am not a back-end developer. Should technical issues arise with your site, I will do my best using my experience and resources to resolve any issues. However, sometimes technical issues do arise beyond this scope and in such cases I will need to write a ticket to get additional support which may cause delays in the launching of your site.

  • Meeting- First, I meet with you (in person or online) to get to know you and your business. I’ll work with you to tailor a package that best accommodates your needs.
  • Planning- I then plan and design the layout, look and feel of your site or design. I work closely with you every step of the way.
  • Execute- Then I get to roll up my sleeves and dive into your project. I’ll always keep you informed of what’s going on throughout the process. Please note I will not grant access to your site during this time to ensure the safety of my work.  All access will be granted to you after your site has gone live and the final payment has been processed.
  • Testing- Once you’re happy, I test. I test your site to ensure your site is working properly and is easy-to-use.
  • Delivery- That’s it!  Your design or website is finished and ready to use! At this point I will hand over your website password and log-in details. I offer a complimentary 30-minute web call to walk you through your site, please ask to book this after your site is finished. Any issues you have with your hosting/domain/email will need to be discussed with your hosting provider directly, but if I can help, I will.  Please note I do not keep back-ups of your website. It is your responsibility to ensure your site is backed-up and maintained.

What is your extended back-up plan?

You may be eligible to sign-up to the extended back-up plan if there is an opening. This plan includes backing-up your site BUT DOES NOT INCLUDE conducting any WordPress/theme/plug-in updates or other maintenance. Fees are payable on the 1st of each month and can be cancelled at any time (if you cancel after the 1st, then you will not be responsible for the following payment, but any payments up to your cancellation will not be refunded). Any fees not paid on time will result in service being suspended. This package does NOT include any changes to the site or to the design, or for any new design.  Visit my contact page here to get in touch with me about any questions regarding the extended back-up plan or for new design or development. Please remember that STUDIOKTR will not be held accountable for site back-ups or any WordPress/theme/plug-in updates that you have carried out on your own, should you choose to maintain your website on your own or with a third party. * Please note my extended back-up plans are only for my WordPress sites. If I design a Wix/Squarespace site for you, back-ups and maintenance are not included.  Please note back-ups I create are stored on my computer and in a back-up drive. If you wish to receive a copy for your own safe-keeping, this is suggested and I will be happy to send you the files for you to store on your own device or on the cloud.

What are your web design prices?

Please see my services pages here for my web design packages. Or, contact me here for a free consultation to discuss your business requirements. Please note that my design prices do not include yearly hosting, domain, e-mail, or maintenance costs.

Web design terms & conditions include, but are not limited to:

  • I, Kate Remmer at STUDIOKTR, will design the look and feel of your website only. If technical issue(s) arise in the development phase of your site, I will use my experience and resources to resolve the issue(s) to the best of my ability. If technical issue(s) go beyond the scope of my abilities, I will endeavour to resolve the issue(s) by submitting tickets to your hosting company/theme developers or web builder customer service to help resolve the issue. Please note that this could delay your launch date, so please be prepared for the unforeseeable. I take responsibility only for design done prior your website’s sign-off/website live date (which ever is later). Any editing/website changes done after this date, are done at the sole responsibility of you, the client.
  • After you, the client, sign off on the design and the site is handed over to you, any new design needs, amends or additions will require a new quote from STUDIOKTR. Please get in touch as I would love to help you with any new work that you require.
  • I highly recommend not sharing your website usernames and/or passwords. Any time you give out your website username/password, it is done at your own risk and I will not be held responsible for any damage/issues relating to your website.
  • After your website goes live, you may schedule a 30-minute, complimentary web call to run through the use of your site.  Please note that after your site is live, I am not responsible for any changes made by you or anyone else.
  • After your site goes live, you, the client, are responsible for the maintenance of your website which includes, but is not limited to, keeping your website regularly backed-up, backing-up before initiating updates (WordPress updates, theme updates, plug-in updates or others), and initiating updates required to keep the site working. Failure to do so could affect your website’s functionality and could leave your website open to security issues. I do not back-up websites and I do not keep back-ups of your site on file, unless you have separately booked on to the extended back-up plan (contact me for details as there are only limited places available).
  • You, the client, are also responsible for keeping up with payments to your chosen web hosting company.  Failure to do so could result in issues with your website’s functionality, service, business e-mail and could result in being exposed to security issues.
  • Any issues you have with your business e-mail needs to be discussed with your hosting company directly.
  • Timelines: I will discuss a timeline for your web site design. However, this will not be set in stone. I will work to the best of my abilities to meet the delivery date as we have discussed, but technical issue(s) can arise, which might cause delays in your launch date – please be prepared for the unforeseeable. Also, I like to be flexible (within reason) if you need time to amend the content you deliver to me. If you require any major changes or updates to your site before your go-live date, it could delay the delivery timelines and cause additional design charges, but I will be up front with this when we discuss your changes.
  • Legality of your site: I work with entrepreneurs the world round and because of this, I am unable to ensure that your website will contain all of the required legal information or other legal requirements for your country / region / location/ etc. As an example (but not limited to), some countries require you have a “cookies” warning for your website visitors, other countries don’t. Some countries may require you to put your full business address on every website page, so it’s visible to all viewers. Different countries have different requirements for e-commerce sites or sites that collect payments. I am not responsible for adding or knowing the legal information that you will be required to have on your website. If you have questions about what is legally required for your web site, please get in touch with a solicitor or lawyer in your location that can advise you further.
  • E-commerce sites: If agreed, I will set up your products with variants, wording and images you provide. I will also set-up any tax information you provide me with, but I am not responsible for the accuracy of any tax information you provide me with. I am in the UK and am not an accountant in your country, please seek help from a qualified accountant if you have any questions about product taxes or any other taxes. It is your responsibility to set-up your payment processes, payment handling, and product shipping, ensure its accuracy, ensure you are using a secure payment method, and ensure it’s working properly on your site. I am not responsible for any profit or loss to yourself or any third parties. It is also your responsibility to double-check your products are set-up with accurate pricing, quantities, shipping and taxes before they are made active on your site.
  • Although I do my best to ensure accuracy in all of my work, I can’t guarantee that my work will be error-free and so I can’t be liable to you or any third-party for damages, including lost profits, lost savings or other incidental, consequential or special damages, even if you’ve advised me of them. This includes setting up payment/shipping/sales tax/etc.. for e-commerce sites. It is your ultimate responsibility to ensure your site is thoroughly updated and checked as necessary, and to ensure it’s accuracy and security.
  • Search engine optimization (SEO) I don’t guarantee improvements to your website’s search engine ranking, but the web pages that I develop are accessible to search engines. If you’re paying for basic SEO set-up, please note there is no guarantee that my set-up will get you at the top of the search engine list. SEO needs to be continually monitored and updated based on the changes Google makes to it’s algorithms and how popular your site is, as well as a whole host of other factors and it can take a lot of time to even rank under your keyword search. Basic SEO set-up will be completed on your main pages only, not on individual blog/portfolio posts, not on sub pages or products, and it does not include setting up your alt-tags for your images. Basic SEO means I will set up your page descriptions and key words only. If you want to get to the top of the search list for your key words, I highly recommend you pay for advertising with Google or other web search engines.

The Oracle (resource library at STUDIOKTR) terms & conditions include, but are not limited to:

“The Oracle” is the name for the resource library at STUDIOKTR. In addition to the above terms and conditions, free items I have created in The Oracle at STUDIOKTR are to get you thinking about how to create a stronger brand and/or website. This information is ONLY for those who have signed up to my email marketing list. You may NOT share the password to this library with anyone else. If I find that a member has shared the password without permission, I, Kate at STUDIOKTR, reserve the right to remove this person from my email list and revoke their access to The Oracle.

From time-to-time, I will change the password access to The Oracle and I will update my newsletter followers.
